Roles and Responsibilities

Services

  • The employing service must determine the appropriate level of disclosure for each role as defined by the Protection of Vulnerable Groups (Scotland) Act 2007 as amended by the Disclosure (Scotland) Act 2020. Managers
  • Discuss any disclosed information with individuals and where appropriate complete information for consideration by Human Resources.
  • Must not engage any employee prior to the completion of satisfactory pre-employment checks, including the appropriate level of Disclosure check. This includes undertaking trial periods.

Lead Signatory/Counter Signatories

  • The Head of HR, ICT & OD is designated Lead Signatory and is responsible for compliance.
  • An appropriate number of counter signatories in the Council will be registered to administer the Disclosure Scotland process and are responsible for satisfying themselves as to the identity of the applicant.

Employees/Prospective Employees/Elected Members/Volunteers

  • Agree to become a member of the PVG Scheme if they are or will be carrying out regulated role.
  • Provide additional information to the Council where disclosed information has been received from Disclosure Scotland.
  • Advise the Council, without undue delay, of any information which may affect their role and/or their membership of the PVG Scheme.
  • Must notify the Council if they are charged or convicted of a criminal offence which may affect their suitability, as outlined in the Council’s Code of Conduct.

Human Resources

  • Ensuring the application of the framework, providing guidance and raising awareness of the Act.
  • Administering the Disclosure Scotland process, making referrals to the Council’s Human Resources Department addressed to Senior HR Adviser or HR Manager.
  • Secure handling, storage, retention and disposal of disclosure information in accordance with Disclosure Scotland Code of Practice and the Council’s policies and procedures.
  • Only share disclosed information with those who legitimately need to see it.

External Providers

External service providers are responsible for ensuring their people (as outlined in the scope above which includes volunteers etc) have the appropriate level of the Disclosure Scotland check. The Council will check that those external service providers who are carrying out regulated roles within its establishments are members of the scheme.

Failure to comply with the council’s Disclosure Scotland processes and guidance may result in appropriate action which may include withdrawal of a conditional offer of employment or disciplinary action. For others not employed by the Council e.g. volunteers, this could result in the Council terminating your engagement, approval or registration, as appropriate.
