Disclosure Scotland Overview

Disclosure Scotland is a Scottish Government executive agency that helps employers make safer decisions when they’re recruiting staff, by checking and sharing information about people’s criminal records to help employers make safer decisions. They also make sure that unsuitable people do not work with vulnerable groups, including children. They keep a list of people barred from working with children and protected adults. The council must comply with the Disclosure (Scotland) Act 2020, as failure to do so is a criminal offence and places the council at risk.

Disclosure Scotland made changes to its services on 1 April 2025; this was to implement the changes arising from the Disclosure (Scotland) Act 2020.

The Disclosure (Scotland) Act 2020 aimed to:

  • focus on protecting the public, while balancing the need for people to move on from offending
  • simplify the process for disclosing criminal history information

This Information Hub provides information on these requirements and provides helpful information to guide and support employees and managers across the council in meeting their legal obligations.
